ALLEY, District Judge.

On August 31, 1982, the plaintiff, Alan Massey, was discharged from the Oklahoma City Police Department. On January 23, 1983, the plaintiff filed a petition for a Writ of Mandamus in the District Court of Oklahoma County to order the defendant, the City of Oklahoma City, to reinstate him as an Oklahoma City policeman. On March 30, 1984, the defendant City filed a demurrer to the plaintiffs petition and the District Court of Oklahoma County sustained the demurrer on the grounds that the plaintiff failed to state a cause of action in his petition.
