The defendant Ezra Pope, in 1885, was an old man 75 years of age, without wife or children, owning 40 acres of land in Lenawee county, upon which, there were no buildings, and but a few acres cleared-He had but little, if any, other property, save an old log-house which he had reserved, upon another piece of land, at the time he sold the same. He made an agreement with his nephew, the complainant, that said complainant should take possession of said land, and have the same at his death, if he would provide a home for him and support him until his death.
