The appellant, Cincinnatns Bradley, filed his petition in the court below praying for a writ of habeas corpus, and that he be discharged from an imprisonment which he alleges to be unlawful. The facts set forth in the petition are, in substance, as follows :

At the May term, 1869, of the Switzerland 'Circuit Court, the appellant was indicted therein for murder in the first ■degree, for killing one Alexander Evans, by shooting him, at said county, on the 20th day of September, 1868. ."When the case was called, the appellant moved for a change of venue from Judge Berkshire, which motion was…
