Background

After the Court granted Chapter 7 Trustee L.D. Fitzgerald’s motion to reopen Debtor Vicki Dougan’s closed bankruptcy case to administer an inheritance, Debtor amended her schedules to claim a homestead exemption in a house devised to her and her sisters under her mother’s will. Docket No. 16. On August 15, 2005, Trustee filed an objection to Debtor’s claim of exemption. Docket No. 17. Trustee’s argument is twofold.
