Pike, J.:

This is an appeal from an order of the trial court *211granting respondents’ motion for summary judgment.

On August 18, 1956 appellant Lockart, who had fallen and sustained a fracture of the mid-right thigh, was taken to the Washoe Medical Center at Reno where he remained as a patient under the care of the two respondent doctors until his discharge from that hospital on November 13, 1956. On the day following his arrival at the hospital appellant was operated upon by respondents who performed an incision, inserting an intra-medullary pin in the fractured femur.…
