FACTS

This action arises out of the Berrymans’ (plaintiffs’) attempted purchase from the Smiths (debtors), of a “Bar and Grill” as well as other real property (the property), located in Phoenix, Arizona. In order to sell the property, the debtors were first required to exercise an option to buy certain land in which they possessed a leasehold interest.
