After reviewing the pleadings and briefs, the Court is now ready to rule. The defendant’s Motion for Summary Judgment is granted.

I. Facts

The plaintiff, Clella Porter Bryant, alleges she fell on October 17,2001, and was injured on the premises of Mostly Sofa’s, [sic] a retail furniture store in Roanoke, Virginia. On September 10, 2003, she filed a negligence action naming “Jeff Rorer, d/b/a Mostly Sofa’s” as the defendant. Service on the defendant was returned not found.
