As a result of the general election held in Willacy county in November, 1924, appellee, Mead, was declared by the commissioners’ court to have been elected, and given a certificate of election, to the office of county judge and ex officio superintendent of public instruction by a majority of one vote over appellant, McCharen, his only opponent. The latter filed a contest of the election in the district court, where judgment was rendered in favor of Mead, whose majority was therein fixed at 6 votes, the count standing 262 for Mead and 256 for McCharen.
