Neely, Justice:
This is an appeal from the Circuit Court of Marion County, West Virginia to determine whether certain beneficiaries accepted benefits under a will and as a result were estopped from later contesting the validity of the will. The proponents, at the close of their evidence, objected to the production of evidence by the contestants and moved for a directed verdict on the grounds that the contestants had accepted cashier’s checks under the will.
