MEMORANDUM OPINION

BLACKBURN, District Judge.

Currently before the court is the Motion for Summary Judgment and Alternative Motion for Judgment on the Pleadings or Summary Judgment filed by the plaintiff, General Agents Insurance Company of America, Inc., (hereinafter “GAINSCO”).
