Appeal from a judgment upon a verdict in the Supreme Court of the District finding appellant guilty of the theft of a Cadillac automobile (engine No. 57R), of the value of $2,500.

The evidence introduced by the government was substantially as follows: At about 6 o’clock on the evening of January 14, 1922, a Mr. William P. Burrows parked his Cadillac automobile (No. 57R152) near Centes Market in this District. A few minutes thereafter he returned and found that his car had disappeared.
