The plaintiff has appealed from an order sustaining a demurrer to his complaint and from a judgment dismissing the action. The trial court sus tained the demurrer on two grounds: (1) Because the complaint failed to allege that plaintiff held a real estate broker’s license; (2) that the contract was within the statute of frauds.

The first question presented is, was plaintiff employed as a real estate broker within the meaning of the provisions of the real estate brokers’ act (Rem. 1927 Sup., §§ 8340-1 to 8340-23 inclusive), which provides:
