In this case we are called upon to address the singular issue of whether an individual may be convicted of driving under the influence of alcohol when the police officer who placed the charge neither observed the individual driving nor occupying any vehicle. Appellant William James Bryant was charged with driving while intoxicated, spinning his wheels, and failing to sign a traffic citation.
