The plaintiff in error, for brevity hereinafter called defendant, was convicted in the district court of Garfield county on a charge of having the unlawful possession of narcotics, and was sentenced to serve a term of three years in the state penitentiary.

On the date charged, certain officers with a search warrant went to the residence of defendant in the town of Garber and made a search of the house, but found nothing of an incriminating nature therein.
