Appeal from a judgment of the Supreme Court (Lamont, J.), rendered June 16, 2010 in Albany County, upon a verdict convicting defendant of the crime of driving while intoxicated (two counts).

A State Trooper and his captain observed defendant sitting on his motorcycle facing the wrong way in the middle of a one-way street. The engine was off but the keys were in the ignition.
