Appeal from an order and judgment of the Supreme Court at Special Term (Doran, J.), entered August 27, 1984 in Washington County, which granted plaintiff’s motion for summary judgment.

Defendant Carmel W. Eitt owns a one-fifth interest as a tenant in common in an approximately 400-acre parcel of real property located on Lake George in Washington County. Her sister, defendant Nancy W. Thompson, owns a two-fifths interest in the property.
