The defendant, Dennis Jobn Caldwell, was charged with illegally taking possession of an airplane and of using it under the provisions of MCLA § 750.367b (Stat Ann 1954 Rev § 28.599 [2]). The case was heard by a jury which rendered a verdict convicting defendant of the crime with which he was charged and the court sentenced him to serve three to five years in prison. This appeal followed.
