UTTER, Justice.

Appellants Tony Hauglum, doing business as South Texas Oil & Gas Consulting, and Patricia Hauglum brought suit against appellees Lee A. Durst, Jr., Barbara A. Durst, and their respective companies, Durst Oil Company and Durst Exploration Company, for the breach of a fiduciary duty arising from a written contract.
