OPINION AND ORDER

KAPLAN, Judge.

This ease is before the Court on plaintiffs’ motion for summary judgment as to liability pursuant to Rules of the Court of Federal Claims (“RCFC”) 56(a). Also before the Court is defendant’s motion to dismiss pursuant to RCFC 12(b)(1) and 12(b)(6), or cross motion for summary judgment on liability, The defendant has also moved, in the alternative, for partial summary judgment on the proper measure of damages.
