Appeal from Des Moines District Court. — Hon. J. D. Smytiie, Judge. Action at law to recover- damages for personal injury. Judgment for defendant upon a directed verdict, and plaintiff appeals.

In November, 1902, tbe defendant was engaged. in the . construction of a telephone line in the city of Burlington. Among its employees was a gang of men engaged in digging holes along the route, under the direction of a foreman named Shane, and another gang, in charge of a foreman named Bitter, were hauling, and distributing the poles. On November 13, 1902, plaintiff, being then in his twentieth year, was employed by the defendant to assist in the work of digging holes.
