Appeal by the defendant, Benjamin Hill Smith, from a judgment of the County Court of the county of Monroe, rendered against him on the 9th day of June, 1915, convicting him of the crime of grand larceny in the first degree, and also from an order entered in the office of the clerk of the county of Monroe on the 4th day of June, 1915, denying his motion for a new trial made upon the minutes.

Kruse, P. J.:

The defendant appeals from a judgment of the County Court of Monroe county convicting him of the crime of grand larceny in the first degree. He challenges the sufficiency of the evidence upon which the judgment of conviction rests and contends that errors were committed upon the trial prejudicial to him.
