Defendant David Lamont Mills was arrested in Fayetteville, North Carolina, after police officers searched him and discovered “crack” cocaine and drug paraphernalia. On 17 April 1990, defendant was charged with felonious possession of a controlled substance and possession of drug paraphernalia. On 10 May 1990, defendant moved to suppress all physical evidence and statements obtained from him; alleging an unlawful seizure and search in violation of his constitutional rights. Judge Henry V.
