The defendants move(1) to dismiss the action as against the United States of America;(2) to dismiss the action as against all the defendants upon the ground that the complaint fails to state a claim upon which relief can be granted;(3) for summary judgment in favor of the defendants upon the ground that the distributees of the estate of Dragoi Batzouroff are ineligible to maintain this action or to claim a return of property ; and(4) for summary judgment in favor of the defendants upon the ground that the action was not commenced within the period prescribed…
