1. Although the exceptions of the defendants to the auditor’s report go to the overruling by him of each ground of their respective demurrers, it is only necessary for this court to deal with the overruling of such grounds as are referred to in the brief of counsel for plaintiffs in error, and these grounds are set forth in the above statement of facts. It is clear, we think, that the petition was not open to demurrer on the ground of misjoinder of parties defendant, nor upon the ground of multifariousness.
