On July 19, 1895, Ray brought his petition against the Home and Foreign Investment and Agency Company, Payne & Tye, and Alonzo Richardson, praying for an injunction to restrain the defendants from proceeding to sell certain realty under a power of sale in a deed given by the plaintiff to the first-named defendant to secure the payment of certain *493promissory notes. This petition waived discovery, and was sworn to by the plaintiff.
