This is an appeal by the state in a criminal case from an order granting defendant’s motion to suppress evidence seized from an automobile.

The facts are not disputed. On February 8,1976, at approximately 5 p.m., Officers Harding and White of the Portland Police Bureau were patrolling in a marked police car in the vicinity of Interstate Avenue and Skidmore Street in northeast Portland.
