At the Fall Term, 1898, of Burke Superior Court the following indictment was found by the grand jury:

The jurors for the State, upon their oath, present: That the Southern Railway Company, a common carrier, a corporation doing business in said Burke County, late of the county of Burke, on the 1st day of January, A.D. 1897, with force and arms, at and in the county (667) aforesaid, unlawfully and willfully did give undue and unreasonable preference to one T. N. Hallyburton, by giving said T. N. Hallyburton a free pass…
