This case comes to this court by writ of error to review a decree of the circuit court of Calhoun county in a parti-, tion suit, entered at the October, 1910, term of said court.

George Keightley and J. M. Keightley filed their bill for the partition of certain lands therein described. The bill alleged that complainants and nine persons named as defendants to the bill were the owners in fee of the land described in the bill and which it was sought to partition.
