1, -2. Robert Grant was indicted for gaming, and tried in tbe county court of Morgan county. After conviction he carried the case to the superior court by writ of certiorari. Upon the hearing the petition for certiorari was “disallowed and overruled,” and a new trial refused. Whereupon he excepted. On the • trial a witness was introduced who testified substantially as follows: He was the chief of police of the town of Madison, and while on duty surprised a party of negroes gambling in a back room.
