1Opinion of the CourtDeNNY, J.
Since the enactment of Chapter 214, section 2, of the Public Laws of 1887, now codified as G.S. 46-23, the owner of a fee or vested remainder in real estate as a joint tenant, or tenant in common, is entitled to a partition of the land or sale for partition of the remainder or reversion thereof. But such partition or sale of a vested remainder in real estate shall not interfere with the possession of the life tenant during the existence of his estate. Moore v.
