On March 15, 2001, the defendant-appellant, Granger Howell, tendered a guilty plea to one count of Conspiracy to Distribute Cocaine, a class A felony, 1 and was sentenced to 180 months imprisonment and five (5) years of supervised release. On February 9, 2004, the defendant filed a Fed.R.Crim.P. 41(g) motion for return of $140,000 seized at the time of his arrest and for the return of three firearms seized during a consented search of his residence.
