Defendant/Appellee, Turkel was charged by the State/Appellant with Driving while Under the Influence. The trial, scheduled to begin *99on June 14, 1983 was preceded by a Motion of the Defendant to suppress the breathalyzer test, premised upon the arresting officer’s refusal to allow the Defendant the right to contact his attorney prior to submitting to the test.
