HALE, District Judge.

This action was brought by the administrator of the estate of Thomas Richardson, late of Lebanon, N. H., against the Boston & Maine Railroad, for personal injuries caused by the alleged negligence of the defendant, and resulting in the death of plaintiff’s decedent. It is alleged that the injury was sustained by Richardson upon a highway in Lebanon, at a grade crossing, where he was run over and killed by a locomotive of the defendant road.
