—Appeal from a judgment of the County Court of Franklin County (Main, Jr., J.), rendered April 20, 1998, convicting defendant upon his plea of guilty of the crime of driving while intoxicated.

Defendant pleaded guilty to the crime of driving while intoxicated as a felony in satisfaction of a multicount indictment and was sentenced to a term of lVs to 4 years in prison and assessed a $5,000 fine. Defendant contends that the sentence is harsh and excessive and should be reduced in the interest of justice given the fact that the People had recommended that he be sentenced to a short jail term and…
