Appellant Thomas McBride appeals a jury verdict for -$135,000 against him on claims of negligence and battery in the shooting of Carl Van Volkenburgh. Mr. McBride claims the trial court erred by refusing to grant his motion for a new trial because Mr. Van Volkenburgh’s attorney repeatedly violated a pre-trial order which prohibited reference during trial to the criminal case involving the same incident.
