Very full and comprehensive briefs have been filed in this case upon the motion for re-hearing, ad dressed mainly to the proposition that the act of the legislature entitled “An act to regulate prairie fires,” (Statutes 1893, p. 597, ch. 38,) which was discussed and construed in the case upon its former consideration, (preceding opinion) and is now here again for dicussion, is ambiguous; that that portion of the eighth section of the act which reads, “Any railroad company operating any line in this Territory, shall be liable for all damages sustained by fire…
