Defendant Woodrow (Woody) Wilkins was charged in the district court of Delaware county with the crime of larceny of livestock, to wit: One cow. He was tried, convicted and sentenced to pay a fine of $250, and serve four years in the State Penitentiary, and has appealed.
The only contention of defendant is that the court erred in granting a severance upon the application of the state after the jury had been impaneled to try the case. With reference to this, the record reveals that an information was filed on January 13, 1943, charging the defendant and Sidney Hilliard and Andrew Williams…
