MEMORANDUM OPINION AND ORDER

BARBOUR, District Judge.

This matter is before the Court on the Cross-Motions for Partial Summary Judgment of Plaintiff, Doris Polk Sims (“Sims”), and Defendant, Inexco Oil Company (“Inexco”), to determine the extent of liability of an oil, gas and mineral lease lessee [Inexco] to its lessor [Sims].

FACTS

On November 15, 1976, Sims, as Lessor, executed an oil, gas and mineral lease referred to as a PAID UP-MISS. Form lease to Inexco, as Lessee, covering approximately 114.79 acres in Lawrence County, Mississippi. The lease provides that “[t]he rights of the Lessor and…
