The opinion of the court was delivered by

Breaux, J.

The plaintiff agreed with the defendant to sell him certain real estate in the city of New Orleans for the price of sixteen thousand dollars.

*784The plaintiff was married to the late J. O. Bartels on the 19th day of February, 1860, and he departed this life on the 19th day of September, 1891.

He was twice married. There were no children, the offspring of the marriage with plaintiff. At the time of his death his son was dead and left his children minors,
