1Opinion of the CourtMaxwell, J.

On the twenty-fifth of March, 1885, the board of regents passed the following resolution: Resolved, That the sum *611of two hundred and fifty dollars be and the same is hereby appropriated out of any money now in the custody of the state treasurer belonging to the regents’ fund, and in the general account thereof, the same to be drawn by Prof. Bessey, dean of the industrial college, to be used in payment of work and material on a botanical garden for said college.” Thereupon an order was issued by the president and secretary of the board, as follows:
