White, J), rendered September 16, 2011, as amended September 29, 2011, convicting defendant, upon his plea of guilty, of criminal sale of a controlled substance in the third degree, and sentencing him to a term of three years, with two years’ post-release supervision, unanimously reversed, on the law, the plea vacated, and the matter remanded for further proceedings.
