MEMORANDUM OPINION

WALTON, District Judge.

This matter comes before the Court on plaintiff Public Utility District No. 1 of Snohomish County, Washington’s (“Public Utility”) Motion for Temporary and Preliminary Injunctive Relief and Expedited Discovery (“Pl.’s Mot.”), and defendant Federal Energy Regulatory Commission’s (“FERC”) opposition thereto. Currently pending before the FERC is a complaint filed by the plaintiff pursuant to section 206 of the Federal Power Act, 16 U.S.C. § 824e, challenging a contract it entered into with Morgan Stanley Capital Group Inc.
