This suit was brought by the American Trust & Savings Bank of El Paso, Neil T. Shearman, and J. P. Mullin, against the Phoenix Insurance Company of Hartford, Conn., to recover on an insurance policy against loss by theft of an automobile,

The owner of the automobile, designated in the policy of insurance as the .“assured,” is Neil T. Shearman, and the policy insured him against loss by theft of the automobile. The policy contained the following clause:

“It is agreed that any loss or damage ascertained or proven to be due to the assured under this policy shall be held payable to American Trust &…
