MEMORANDUM

HERMAN, District Judge.

On July 13, 1970 this court denied defendants’ and the intervenor’s motion to dismiss the above-captioned matter and deferred decision on plaintiffs’ mo*406tion to dismiss certain affirmative defenses raised by the defendants and intervenor pending filing of additional briefs and oral argument (see, 315 F.Supp. 7 1970). Delay was incurred by reason of the dissolution of the law firm representing the defendants and intervenor, and the inability of counsel to arrange for an agreeable time to appear before the court for oral argument.
