Appeal from Wright District Court. — C. E. Albrook, Judge. The plaintiff’s right of way having been assessed for its alleged proportion of the cost of ditches constructed in the drainage district named in the caption, it appealed therefrom to the district court where the assessment was confirmed, and plaintiff now prosecutes a further appeal to this court.

Drainage District No.-43 includes an area of about 1,008 acres, and the total cost of the improvement is about $10,000. The plaintiff’s right of way, 100 feet wide, extends into and across the district for a distance of about 1 2/10 miles, and is crossed in three places by the main ditch or laterals. The assessment laid upon the right of way is $682.97. There is no objection to the regularity of the organization of the district or to the proceedings leading up to the final assessment of benefits.
