— Order unanimously modified on the law and as modified affirmed without costs and judgment granted in accordance with the following Memorandum: This matter, commenced as a CPLR article 78 proceeding, was improperly transferred to us and was therefore remitted to Supreme Court for conversion to a declaratory judgment action and determination (Matter of Cram v Town of Geneva, 182 AD2d 1102).
