On July 4, 1927, in the afternoon, Joe Delius, the husband of the defendant in error, was fatally injured by the, overturning of a truck on which he was riding, belonging to the plaintiff in error and driven by Ed Peake, one of his employees. This suit was instituted by his widow for the benefit of herself and her two children as a common-law action, against John Oman, Jr., to recover damages for the death of her husband, upon the ground of negligence of Peake, the agent and servant of Oman, while in the course of his employment, as the proximate cause thereof.
