This suit was instituted by appellant against appellee to recover on two promissory notes executed by appellee, each in the sum of $S3,333.34, payable respectively on September 1, 1913, and September 1, 1914, each bearing date of May 13, 1911, the consideration therefor being part of the purchase money of about 21,845 acres of land in Ua Salle county, Tex. It was alleged that appellee had paid $123,333.34 on the land and that the two notes sued on evidenced the balance due on the purchase money of the land.
