Action for damages for personal injuries suffered in a fall from the running board of defendants’ truck. Trial to a jury resulted in verdict and judgment for plaintiff for $5000. Defendants moved for judgment notwithstanding verdict or for new trial. The motion for new trial was sustained on one ground only, viz.: errors connected with the direct examination of a witness, Dennis Oakes. From that part of the order plaintiff appeals. Defendants cross-appeal from the overruling of their motion for judgment notwithstanding verdict.
