Respondent, Albert Case, brought this action against the appellant, Peter Peterson, a widower, to recover damages as the result of coming in contact with an electrically charged fence which the appellarit maintained upon his farm along the side of the public highway. In his answer, the appellant denied that he maintained the fence -and alleged affirmatively that it was installed by his tenant; that, if the respondent did come in contact with the fence, he had entered upon the leased land and was a trespasser, and, if he were injured, it was the result of his own negligence.
